Background Check Authorization and Consent

The authorization must be a standalone document (not part of the job application under FCRA). Clearly state that a consumer report may be obtained for employment purposes. Obtain the applicant's written consent. Before taking adverse action based on the report, provide the applicant with a pre-adverse action notice and a copy of the report. Wait a reasonable time before taking final adverse action. Comply with state ban-the-box laws if applicable.
