Specify which claims are subject to arbitration (discrimination, wrongful termination, wage disputes). Name the arbitration provider (AAA, JAMS). Address who pays arbitration costs (generally the employer pays the arbitrator's fees). Preserve the employee's right to file charges with government agencies (EEOC, NLRB). Include a class action waiver if desired. Provide adequate consideration. Some states and courts scrutinize mandatory arbitration agreements closely.
