I-864 Affidavit of Support

Legal contract in which the sponsor agrees to financially support the immigrant and maintain their income above 125% of the federal poverty line.

Instructions

Instructions

  • Sponsor: The petitioner on the immigrant petition (must be the sponsor or a joint sponsor)
  • Income Requirements: Demonstrate income at or above 125% of the federal poverty guidelines for your household size
  • Documents: Federal tax returns (3 most recent years), W-2s, pay stubs, employment letter
  • Assets: If income is insufficient, you can use assets valued at 3x the difference (5x for spouse petitions)
  • Joint Sponsor: If you don't meet income requirements, a joint sponsor can file a separate I-864
  • Household Size: Include yourself, dependents, previously sponsored immigrants, and the immigrant(s) being sponsored
  • Important: The I-864 is a legally binding contract. Your obligation continues until the immigrant becomes a U.S. citizen, earns 40 qualifying work quarters, dies, or permanently departs the U.S.
