The employer must conduct recruitment efforts to test the U.S. labor market before filing: place a job order with the state workforce agency, run two Sunday newspaper ads, and conduct three additional recruitment steps. The job requirements must reflect actual business needs and cannot be tailored to the foreign worker. Prevailing wage determination must be obtained from DOL. File electronically at the FLAG system. Supervised recruitment or audit may apply.
