Special Needs Trust (Third Party)

Fund the trust with assets from someone other than the beneficiary (parents, grandparents). Name an experienced trustee familiar with public benefits rules. Include spendthrift provisions and language stating the trust supplements rather than replaces government benefits. The trustee may spend for supplemental needs (education, recreation, personal care items) but not for basic food and shelter covered by benefits.
