Instructions

  • Identify the Court: Enter the issuing court's name and case number
  • Name the Recipient: Full legal name and address of the person being subpoenaed
  • Specify the Command: Check the appropriate box for testimony, document production, or both
  • Date and Location: Provide the date, time, and place of appearance
  • Documents Requested: If producing documents, attach a schedule describing each item
  • Service: Must be served personally and include witness fees and mileage

    • Fees: Witness fee of $40/day plus mileage at current IRS rate

    Note: Subpoenas may be quashed if they impose an undue burden. See FRCP Rule 45.
