Patent Application Filing Requirements

Applications for patents must be filed in the United States Patent and Trademark Office and must include a specification with at least one claim, drawings when necessary, an oath or declaration, and the required filing fee. The specification must describe the invention in clear, concise terms and enable a person skilled in the art to make and use the invention.

Utility patent applications are examined by patent examiners who evaluate novelty, non-obviousness, and utility. The application process includes office actions, responses, and potentially appeals. Patents are granted for a term of 20 years from the filing date.
