When a petition supported by a sufficient showing of interest (30 percent of employees) is filed, the NLRB conducts proceedings to determine whether employees wish to be represented by a labor organization. The Board conducts secret-ballot elections and certifies the results.
Employers and unions must follow rules governing campaign conduct. Threats, promises of benefits, and other coercive actions are prohibited. If the Board finds objectionable conduct that materially affected the election results, it may order a new election. Pre-election hearings address issues of unit appropriateness and voter eligibility.
