Trademark Registration Application Requirements

Applications to register trademarks must include the applicant's name and address, a clear drawing of the mark, a listing of the goods or services associated with the mark, the filing basis (use in commerce or intent to use), and the required filing fee. Specimens showing the mark as used in commerce must be submitted.

The USPTO examines applications for compliance with statutory requirements including likelihood of confusion with existing marks, descriptiveness, and functionality. Approved marks are published for opposition, and if no opposition is filed, the mark proceeds to registration. Registrations must be maintained through periodic filings.
