Previous

The Secretary shall list species as endangered or threatened and prohibit the taking of listed species.

Amended

The Secretary shall designate critical habitat concurrently with listing and listing decisions must be based solely on the best scientific data available. An Endangered Species Committee may grant exemptions from the Act for federal actions of regional or national significance.

Added provisions for habitat conservation plans allowing incidental take permits for non-federal entities.

Previous

The taking of any endangered species is prohibited, with exceptions only for scientific purposes or the enhancement of survival.

Amended

The Secretary may issue incidental take permits to non-federal entities that submit an approved habitat conservation plan showing the taking will be minimized and mitigated and will not appreciably reduce the likelihood of survival of the species.
